Purchase Agreement

This Purchase Agreement sets out how you order, receive, pay for, and get refunds on products bought on dndware.dev. It applies together with our Terms of Service and Privacy Policy. Where this Agreement and the Terms of Service both cover ordering, delivery, or refunds, this Agreement applies.
Please read it before you buy. If you do not agree with any part of it, do not place an order. Nothing in this Agreement limits any right you have under the mandatory consumer law of your country of residence.
1. General Provisions
The products and prices shown on dndware.dev are an offer by DND (DND Software) to any person who can legally enter into a contract. In line with Article 6:217 of the Dutch Civil Code, you accept this offer by completing payment for an order. Your payment is complete and unconditional acceptance of this Agreement, including its appendix, and of the Terms of Service.
In this Agreement:
- DND, we, us: DND Software, which develops the software and grants the license.
- Buyer, you: the person who places and pays for an order.
- Merchant of record: Link, a Stripe company, which sells the order to you on our behalf, collects payment and tax, and issues your receipt.
- Product: access to software described on the Website for the chosen duration, delivered through the DND loader, together with technical support for using it.
- License: your personal, non-transferable right to use a Product under the Terms of Service.
- Order: your request, placed on the Website, to buy one or more Products.
- Website: https://dndware.dev.
2. Subject of the Agreement
The subject of this Agreement is the delivery of the Products listed on the Website at the moment you place your Order, at the prices and conditions shown at that moment. We may change prices and the range of Products at any time; the conditions that applied when you paid stay in force for that Order.
We provide access to the software and technical support. We do not guarantee that a Product will keep working for any period of time or stay compatible with future updates of games, platforms, anti-cheat systems, or operating systems (see Section 16 of the Terms of Service).
3. Placing an Order
- You need a DND account to order. To create one you provide a username and an email address.
- You choose a Product and duration, confirm that you accept the Terms of Service and this Agreement, and request immediate delivery (see Section 7). You then pay on the secure checkout page of Stripe.
- The Agreement is concluded at the moment your payment is confirmed. That date counts as the date of your Order.
- Descriptions, images, and feature lists on the Website are for information only and may not reflect every property of a Product. If you have questions about a Product, ask us before you order.
4. Delivery
- Delivery is automatic: the License is added to your account as soon as the payment is confirmed, usually within minutes and at the latest within 1 business day.
- An Order is fully delivered once the License has been added to your account. We record the moment of delivery. Whether and when you use the Product does not change this.
- If we cannot deliver a Product, including for reasons beyond our control, we may cancel it from your Order and refund what you paid for it. We will tell you by email or through your account.
- If delivery went wrong through our fault, we deliver again at no extra cost.
- We are not responsible for what you do with a Product after delivery.
5. Prices and Payment
- Prices on the Website are in euros and exclude VAT. VAT or sales tax, where applicable, is calculated from your billing address and added at checkout, where you see the final price before you pay.
- Payment is handled by Stripe. Link, a Stripe company, is the merchant of record: it collects the payment and tax and sends your receipt and invoice. The charge appears on your statement as LINK.COM*.
- You can pay with the methods shown at checkout, such as cards, Apple Pay, Google Pay, and local payment methods.
- We may change prices at any time by updating the Website. A price change never affects an Order that has already been paid.
6. Cancellation Before Delivery
You may cancel an Order at any time before it is delivered. Because delivery normally happens within minutes of payment, contact us straight away at [email protected] if you want to cancel. Once the License has been added to your account, the Order has been performed and can no longer be cancelled, except as described in Section 8.
7. Right of Withdrawal
Consumers in the European Union normally have a 14-day right of withdrawal for online purchases. For digital content this right ends as soon as delivery starts, if you asked for immediate delivery and acknowledged that you lose the right of withdrawal (Article 16(m) of Directive 2011/83/EU and Article 6:230p of the Dutch Civil Code).
Before you pay, you tick a box to request immediate delivery and to acknowledge that you lose the right of withdrawal. The time of that consent is recorded with your Order. After delivery, a refund is only possible in the cases described in Section 8.
8. Refunds
Because you ask for immediate delivery and give up your right of withdrawal (Section 7), delivered Orders are not refunded, whether or not you have used the Product. The only exceptions are the two below and any case where mandatory law requires a refund.
Product that does not work because of us
If a Product is of unsatisfactory quality (see the Appendix), tell us straight away at [email protected], and in any case within 7 calendar days of delivery. We will first try to solve the problem with you. If we can't, we refund the Order. This does not apply if you refused our support's help, did not follow our instructions, or did not give us the information we asked for.
Privacy Protector
If Privacy Protector does not work on your system even after our support has tried to resolve it with you, we refund that Order. For Privacy Protector you have 14 calendar days from delivery to ask.
How refunds work
- Send your request to [email protected] from the email address of your account, with your username and a description of the problem.
- We review the request within 10 business days of receiving it.
- An approved refund is paid back through Link to the payment method you used, within 5 business days of approval. If that is not possible, we agree another way with you.
- When an Order is refunded in full, the License it added is removed from your account automatically.
- There is no refund if your account was banned or restricted for breaking the Terms of Service, or for time lost to game or platform updates (see the Terms of Service, Section 16).
- Link (Stripe) may also issue refunds under its own policies as merchant of record.
9. Rights and Obligations
DND
- Delivers the Products of proper quality within the time set out in Section 4, and provides technical support for them.
- May change prices and Products by updating the Website.
- Keeps your personal data confidential and uses it only as described in the Privacy Policy.
Buyer
- Pays for the Order.
- Gives accurate and complete information when ordering and when asking for support.
- Uses the Products only as allowed by the Terms of Service.
- May expect Products of the quality described in this Agreement.
10. Liability
- The Website, its content, and the Products are provided "as is", without warranties beyond those in this Agreement and mandatory law.
- We are not liable for how you use a Product, including use that breaks the law or the rules of other software, games, or platforms. You understand the risks of using such software and accept full responsibility for the consequences.
- We (and our partners) are not liable for direct, indirect, incidental, or other damage, including but not limited to account bans or suspensions, lost progress or items, and any other material or immaterial damage, arising from the use of or inability to use the Website or a Product, to the extent the law allows.
- If third parties or authorities make claims against us because of your unlawful use of a Product, you compensate us for all resulting losses and costs.
- The full disclaimer, limitation of liability, and indemnification are in Sections 2 to 4 of the Terms of Service.
11. No Transfer of Access
You may not transfer, sell, share, lend, or exchange your account, License, or access to a Product. If you do, we may end your access without a refund and refuse to sell to you in the future.
12. Complaints
Send complaints about an Order to [email protected] or through our Discord. We aim to reply within 2 business days. Questions about the payment itself can also go to Link's support, which handles payment-related requests for Stripe's merchant-of-record sales.
13. Changes to This Agreement
We may change this Agreement at any time. A new version applies from the moment it is published on the Website, unless it says otherwise, and only to Orders placed after that. Please check the current version before you place a new Order.
14. Personal Data
We process your personal data only to perform this Agreement and as described in our Privacy Policy, which forms part of this Agreement. Link and Stripe process your payment data as independent controllers under their own privacy policies.
15. Governing Law
This Agreement is governed by Dutch law. Disputes are submitted to the competent court in the Netherlands, without prejudice to any mandatory right you have as a consumer to go to the courts of, or rely on the law of, your country of residence.
Appendix: Product Quality
Satisfactory quality: the Product can be started and works, on our computers and for other Buyers.
Unsatisfactory quality: you have no access to the Product, or it cannot be started, because of a fault on our side. Problems caused by your hardware, by third-party software, or by updates to games or platforms are not unsatisfactory quality and are not grounds for a refund.
